Terms of Service

1. Acceptance

By accessing or using PhinHub (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

PhinHub is an independent, fan-built community for Miami Dolphins fans. It is not affiliated with, endorsed by, or sponsored by the National Football League (NFL), the Miami Dolphins, or any team, player, or league entity. All team names, marks, and imagery referenced on the Service belong to their respective owners and are used for editorial commentary and fan discussion under fair use.

3. Eligibility

You must be at least 13 years old to create an account. By signing up you represent that the information you provide is accurate and that you are legally able to enter this agreement.

4. Your account

You are responsible for keeping your account credentials secure and for any activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

5. Acceptable use

You agree not to:

• Post content that is unlawful, harassing, hateful, threatening, defamatory, obscene, or that infringes another person's rights.
• Impersonate any person, including NFL personnel, team employees, players, or other community members.
• Spam, scrape at scale, automate posting, or attempt to overload the Service.
• Attempt to gain unauthorized access to accounts, infrastructure, or restricted areas.
• Use the Service to distribute malware, conduct fraud, or violate any law or regulation.
• Post sports betting content if you are under the legal gambling age in your jurisdiction.

6. Content you post

You retain ownership of content you post. By posting, you grant PhinHub a worldwide, non-exclusive, royalty-free license to host, store, display, distribute, and surface that content within the Service and in connection with the Service's operation (including in feeds, search results, and shareable previews). You represent that you have the rights necessary to grant this license for any content you post.

7. Moderation

We may remove content or suspend accounts that violate these Terms or that we reasonably believe to be harmful to the community, at our sole discretion and without prior notice.

8. Phinhub Premium and payments

Phinhub Premium is an optional paid subscription billed through Stripe. Subscriptions renew automatically until canceled. You can cancel any time from your billing page; cancellation takes effect at the end of the current billing period and does not retroactively refund prior charges except where required by law.

9. Advertising and affiliate links

The Service may display third-party advertising, sportsbook promotions, and affiliate links. Clicking a sportsbook promotion or affiliate link may result in compensation to PhinHub. We do not control and are not responsible for the products, services, or content offered by third parties.

10. Responsible gambling

Sports betting promotions on the Service are intended for users of legal gambling age in jurisdictions where sports betting is legal. If you or someone you know has a gambling problem, call 1-800-GAMBLER for confidential help.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Pick'em outcomes, scores, schedules, collectibles, and rewards are for entertainment only and confer no monetary value unless explicitly stated.

12. Limitation of liability

To the maximum extent permitted by law, PhinHub and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Service.

13. Indemnification

You agree to defend, indemnify, and hold harmless PhinHub and its operators from any claim arising out of your content, your use of the Service, or your violation of these Terms.

14. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

15. Changes

We may update these Terms from time to time. The “last updated” date at the top of this page reflects the most recent revision. Continued use of PhinHub after a change indicates acceptance of the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida.
